These Terms of Use (the "Terms") govern access to and use of the MyHairMail Agent Tools (the "Agent Tools" or "Tools"), a set of software tools and data services made available by MyHairMail, operated by Volare Holdings LLC ("MyHairMail," "we," "us," or "our"), including through the Model Context Protocol ("MCP") and any associated endpoints, interfaces, or documentation.
By accessing, connecting to, or using the Agent Tools, you ("you," "your," or "User") agree to be bound by these Terms. If you access or use the Agent Tools on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization. If you do not agree to these Terms, you must not access or use the Agent Tools.
1.1 "Agent Tools" means the MCP server, tools, functions, endpoints, and related data services made available by MyHairMail to assist consumers with shopping decisions.
1.2 "Returned Data" means any data, content, output, or response provided by the Agent Tools, including product information, pricing, and availability statements.
1.3 "Session" means a single, continuous interaction between an end user and the Agent Tools for the purpose of assisting that end user's shopping activity.
1.4 "Access Credentials" means any API key, token, tier assignment, or other credential issued to enable access to the Agent Tools.
2.1 Limited License. Subject to your continuous compliance with these Terms, MyHairMail grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Agent Tools solely for the purpose described in Section 2.2.
2.2 Permitted Purpose. The Agent Tools are provided solely to assist individual consumers in making shopping decisions in real time. Any use outside this purpose is not authorized and is a material breach of these Terms.
2.3 No Other Rights. Except for the limited license expressly granted in these Terms, no rights are granted to you, whether by implication, estoppel, or otherwise. All rights not expressly granted are reserved by MyHairMail.
You must not, and must not permit or enable any third party to, do any of the following in connection with the Agent Tools or the Returned Data:
3.1 Systematic collection. Systematically collect, harvest, scrape, crawl, index, or otherwise extract Returned Data in bulk or through automated means beyond what is necessary to assist an individual consumer in real time.
3.2 Storage beyond a Session. Store, cache, retain, or persist Returned Data beyond the duration of a single user Session, except where strictly required to complete that Session.
3.3 Resale or redistribution. Resell, redistribute, license, sublicense, republish, or otherwise make the Returned Data available to any third party.
3.4 Competitive analysis. Use the Returned Data for competitive analysis, benchmarking, market research, or any purpose intended to evaluate, replicate, or compete with MyHairMail or its business.
3.5 Price or inventory monitoring. Use the Agent Tools or Returned Data to monitor, track, or compile pricing, stock levels, availability, or catalog changes over time.
3.6 Training datasets. Use the Returned Data, in whole or in part, to create, train, fine-tune, evaluate, or improve any machine learning model, dataset, or artificial intelligence system.
3.7 Circumvention. Circumvent, disable, or interfere with any rate limit, access tier, security measure, authentication, or usage control applicable to the Agent Tools.
3.8 Misuse. Access the Agent Tools using invalid, shared, or unauthorized Access Credentials, or otherwise use the Agent Tools in any manner that is unlawful, fraudulent, or that could damage, disable, overburden, or impair the Agent Tools or MyHairMail's systems.
4.1 Limits May Change. Rate limits, quotas, access tiers, and the scope of available Tools are subject to change at any time, at MyHairMail's sole discretion, without notice.
4.2 Circumvention Terminates the License. Any attempt to exceed, evade, or circumvent applicable rate limits or access-tier restrictions immediately and automatically terminates your license to access and use the Agent Tools, without further notice.
5.1 Provided "As Is." The Agent Tools and all Returned Data are provided on an "as is" and "as available" basis.
5.2 Point-in-Time Statements. All availability, stock, pricing, and inventory statements are point-in-time representations reflecting information available at the moment of the response. Such statements are not guarantees and may change at any time without notice. MyHairMail does not warrant that any Returned Data is accurate, complete, current, or will remain valid beyond the moment it is provided.
5.3 No Reliance. You are solely responsible for any decision or action taken in reliance on the Returned Data.
6.1 Seeded Verification Records. The Returned Data may contain seeded verification records ("canaries") — synthetic entries embedded by MyHairMail for the purpose of detecting unauthorized use.
6.2 Evidence of Breach. The appearance of any such seeded verification record in any third-party dataset, product, service, or system constitutes evidence of a breach of these Terms by the party responsible for that dataset, product, service, or system.
6.3 Monitoring. MyHairMail may monitor access to and use of the Agent Tools to verify compliance with these Terms and to maintain the security and integrity of its systems.
7.1 The Agent Tools, the Returned Data, and all associated software, documentation, trademarks, and content are and remain the exclusive property of MyHairMail and its licensors, and are protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of any of the foregoing to you.
8.1 By MyHairMail. MyHairMail may suspend, restrict, or terminate your access to the Agent Tools at any time, with or without cause and with or without notice, including for any actual or suspected breach of these Terms.
8.2 Effect of Termination. Upon termination or expiration of your license for any reason, you must immediately cease all use of the Agent Tools and delete all Returned Data in your possession or control. Sections 3, 5, 6, 7, 9, 10, 11, and 13 survive termination.
To the maximum extent permitted by applicable law, the Agent Tools and Returned Data are provided without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. MyHairMail does not warrant that the Agent Tools will be uninterrupted, secure, error-free, or free of harmful components.
To the maximum extent permitted by applicable law, in no event will MyHairMail or Volare Holdings LLC be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your access to or use of (or inability to access or use) the Agent Tools, whether based in contract, tort, strict liability, or any other theory, even if advised of the possibility of such damages. In no event will MyHairMail's aggregate liability arising out of or relating to these Terms exceed the greater of (a) the total amounts, if any, paid by you to access the Agent Tools in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
You agree to indemnify, defend, and hold harmless MyHairMail, Volare Holdings LLC, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your access to or use of the Agent Tools, your Returned Data, or your breach of these Terms.
MyHairMail may modify these Terms at any time. Revised Terms will be effective when posted or otherwise made available. Your continued access to or use of the Agent Tools after revised Terms take effect constitutes your acceptance of them. It is your responsibility to review these Terms periodically.
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Agent Tools shall be the state or federal courts located in Davidson County, Tennessee, and you consent to the personal jurisdiction of those courts.
14.1 Entire Agreement. These Terms constitute the entire agreement between you and MyHairMail regarding the Agent Tools and supersede all prior or contemporaneous understandings on that subject.
14.2 Severability. If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
14.3 No Waiver. MyHairMail's failure to enforce any provision of these Terms is not a waiver of its right to do so later.
14.4 Assignment. You may not assign or transfer these Terms or any rights under them without MyHairMail's prior written consent. MyHairMail may assign these Terms without restriction.
